OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were potentially exposed to falling and crushing hazards associated with the scaffolding system, which OSHA contends was not installed in accordance with manufacturer's guidelines.  OSHA contends that a fabricated frame scaffolding system erected by Jeff MacTaggart Masonry (JM2) was not tied into the structure as outlined by the manufacturer when wrapped with plastic or a similar substance.  Specifically, where design and layout of the window openings for the subject project prevented the installation of scaffold ties in strict compliance with manufacturer's recommendations for enclosed scaffolds, JM2 management did not adequately investigate alternative means or methods to secure the scaffold to the structure.    AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS:    (a) Ensure that all competent persons for scaffold erection are familiar with both the Occupational Safety and Health Administration's standards on scaffold use and erection as well as any applicable industry recognized data on scaffold use and erection.    (b) Ensure all competent persons for scaffold erection have access to written procedures emphasizing additional inspection criteria when scaffolds are wrapped in plastic to ensure scaffold erection.    (c) Develop and implement a disciplinary action program and procedures to ensure that employees perform the inspections as noted in (b) above.
