29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:  (a) Packing Room - The ice cream line used liquid nitrogen to freeze candy.  The employer had a machine specific lockout/tagout procedure for the ice cream line; however, this procedure did not include the liquid nitrogen as an energy source and so did not include steps for how to de-energize and lockout/tagout the liquid nitrogen, on or about January 20, 2015.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.147(c)(5)(i): Locks, tags, chains, wedges, key blocks, adapter pins, self-locking fasteners, or other hardware were not provided by the employer for isolating, securing or blocking of machines or equipment from energy sources:  (a) Hot Room - The employer did not provide enough lockout locks to authorized employees.  The employer provided only one lock to an employee who operated and set up Molding Line 2 and provided only one lock to an employee who did sanitation on Molding Line 2, and this machine had two energy sources, electric and pneumatic, so the operator and the sanitation employee only locked out the electric when performing servicing and maintenance work, exposing these employees to hazards such as caught-in and struck-by moving parts, on or about January 20, 2015.  (b) Packing Room - The employer did not provide enough lockout locks to authorized employees.  The employer provided only one lock to an employee who operated a Carle & Montanari Foil Machine, and this machine had two energy sources, electric and pneumatic, so the operator only locked out the electric when performing servicing and maintenance work, exposing the employee to hazards such as caught-in and struck-by moving parts, on or about January 20, 2015.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.147(d)(4)(i): Lockout or tagout devices were not affixed to each energy isolating device by authorized employees:  (a) Hot Room - When the operator and sanitation employee did servicing and maintenance work, such as set up and cleaning, on Molding Line 2, the employees only applied lockout/tagout to the electrical energy; however, the molding line had electric and pneumatic energy, exposing employees to hazards such as caught-in and struck-by moving parts, on or about January 20, 2015.  (b) Packing Room - An employee cleared a foil jam on the Carle & Montanari CM Y55/CB Foil Machine 2, serial number 5508CB, machine number 3010.  This machine had electric and pneumatic energy, and the operator locked out only the electrical energy to the machine when performing this servicing and maintenance work, exposing the employee to hazards such as caught-in and struck-by moving parts, on or about January 20, 2015.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.147(c)(7)(i): The employer did not provide training to ensure that the purpose and function of the energy control program was understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls were acquired by employees:  (a) Hot Room and Packing Room - The lockout/tagout training provided by the employer did not ensure that all authorized employees had acquired the knowledge and skills required for the safe application, usage, and removal of the energy controls in that some authorized employees only locked out/tagged out the electrical energy on machinery, such as Molding Lines and Foil Machines, which had electrical and pneumatic energy.  These employees did not know of the need to lockout/tagout the pneumatic energy, exposing the employees to hazards such as caught-in and struck-by moving parts, on or about January 20, 2015.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  (a) Hot Room - To make adjustments to the depositors on Molding Lines 2 and 4, operators must remove the fixed guards from the depositor/hopper in order to access the knobs that control the depositor adjustments.  Operators had power on to the machinery while making the adjustments.  The employer did not provide any other method of machine guarding to protect operators from exposure to moving machine parts while operators made depositor adjustments with the fixed guards removed, on or about January 20, 2015.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
