29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):  Construction site: On or about January 21, 2015, and at times prior thereto, two employees were working on the scaffold not fully planked, one on the south side and the other on the west side of the building. This condition exposed the employee to a fall hazard of greater than 10-feet to the ground level.

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames,  or uprights did not bear on base plates, mud sills or other adequate firm foundation:  Construction Site: On or about January 21, 2015, and at times prior thereto, two employees working on the scaffolds which were missing some base plates and mud sills. This condition exposed the employees to a fall hazard of greater than 10-feet to the ground below.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Cross braces were used as a means of access:  Construction site: On or about January 21, 2015, and at times prior thereto, two employees were observed climbing the scaffold side to gain access and egress on the west side of the building. This condition exposed the employees to a fall hazard greater than 10-ft. to the ground below.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:  Construction site: On or about January 21, 2015, and at times prior thereto, two employees were working on scaffolds without any form of fall protection, one on west side and the other on the south side of building. This condition exposed the employee to a fall hazard greater than 10-feet to ground below.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  Construction site: On or about January 21, 2015, and at times prior thereto, two employees working on the scaffolds without any form of fall protection. The employer did not provide a training program to enable employees to recognize the hazards of falling. This condition exposed the employees to a fall greater than ten feet to the ground below.
