OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Employees riding the lift located in the parts department were exposed to crushing and fall hazards of 8 feet to the concrete floor below in that the lift was not designed for personnel to ride. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS: Develop a policy and train employees on the safe operation of the Series M Vertical Reciprocating Conveyer (VRC). ASME B20.1-2012 paragraph 6.21.1(c) states, "Riding the conveyer shall be forbidden to all personnel."

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): Employees were exposed to hazards including struck by and crushing hazards in that forklift operators were not provided training before operating powered industrial trucks such as the Clark forklift .
