29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets. An employee was exposed to overhead hazards while working in a trench approximately seven feet deep and was not wearing a hard hat or other protective helmet. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the certification of corrective action worksheet).

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). An employee working in a trench approximately seven feet below grade was exposed to cave-in hazards. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
