OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    On or about January 22, 2015, and times prior to, at 2020 Riverfront Road in Van Buren, Arkansas, employees were not prohibited from riding within the bucket of a CAT 330L, Excavator to access and egress from barges.  This condition exposed employees to falls and crushing hazards.

29 CFR 1910.110(h)(12): Conspicuous signs prohibiting smoking were not posted within sight of customers served at LP gas dispensing areas:    On or about January 22, 2015, and times prior to, at 2020 Riverfront Road in Van Buren, Arkansas, a "No Smoking" sign was not posted on or near the 500 gallon propane tanks staged in the propane area.  This condition exposed employees to a fire hazard.
