OSH ACT of 1970 Section (5)(a)(1): 29 CFR Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that its employee was potentially exposed to crushing and struck-by hazards:    Location: 240 West Sixth Street, Boys and Girls Club.    a) An employee of the employer was potentially exposed to a crushing hazard from a suspended load, after leaving the crane unattended with the load suspended in a second story window, where this employee did not fully follow relevant portions of the Manufacturer's Instructions for Crane Use, and ASME B30.22-2010, Section 22-3.1.3.3.1 Responsibilities of the Crane Operator.      b) The Employee was also potentially exposed to struck-by hazards while leaving the seat unattended, where the crane seat safety switches were locked in bypass, enabling functioning of boom controls through contact. In addition, the rubber bumpers (devices) which allow for indication of the operator presence in the seat, were not adequately inspected and adjusted, enabling the boom controls to function without operator presence in the seat.
