29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  The employer does not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment is isolated from the energy source and rendered inoperative. This violation occurred on or about January 23, 2015, and at times prior thereto, in the shop where authorized and affected personnel were exposed to electrical and crushed-by hazards while performing service and/or maintenance on a Chicago Riveter (M3) SN 912-8896-SS without energy control procedures, training, and periodic inspections for the isolation of hazardous energy.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to establish a program consisting of an energy control procedure, employee training and periodic inspections.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  The employer does not guard all the rotating parts of machines whose operation exposes employees to injury.    a. This violation was observed on or about January 23, 2015, in the production area on the east wall where an employee was exposed to a caught in or struck-by hazard when operating a Chicago Riveter (M3) SN 912-8896-SS without a point of operation guard.  b. This violation was observed on or about January 23, 2015, in the production area on the east wall where an employee was exposed to a caught in or struck-by hazard when operating a Chicago Riveter (M5) SN 912-2384 without a point of operation guard.  c. This violation was observed on or about January 23, 2015, in the production area on the east wall where an employee was exposed to a caught in or struck-by hazard when operating a Challenge Champion Shear without a point of operation guard.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that machine guarding is provided to protect the operator and other employees in the machine area.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met. This violation occurred on or about January 23, 2015, and at times prior thereto, in the production area where employees were using chemicals such as, but not limited to, Nazdar 9700 Series All Purpose Ink, Nazdar RE189 Thinner, Nazdar RE181 Retarder Solution, Krylon Lacquer Thinner, without a written hazard communication program in the workplace.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.
