OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees were exposed to struck by and fall hazards. a) On or about January 22, 2015 and at times prior, the employer exposed his employees to struck-by and fall hazards in that employees were permitted to operate a International Elliott Crane Truck with broken welds on the pivot mechanism for the boom mounted personnel basket.
