29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator had successfully completed the training required by paragraph (l):    a.  At the work site, employees used a fork lift truck to receive and store metal parts, to move parts and finished products throughout the work site, and to load finished products for shipment.  The employer had no training program for employees who operated the fork lift truck.

29 CFR 1910.178(q)(6): Industrial trucks shall not be altered so that the relative positions of the various parts are different from what they were when originally received from the manufacturer, nor shall they be altered either by the addition of extra parts not provided by the manufacturer or by the elimination of any parts, except as provided in paragraph (q)(12) of this section. Additional counterweighting of fork trucks shall not be done unless approved by the truck manufacturer.   a.  At the work site, the employer provided a man lift platform to lift employees to access items on the racking.  The employer did not have the man lift platform authorized by the manufacturer of the fork lift truck.

29 CFR 1910.303(g)(2)(i): Except as elsewhere required or permitted by this standard, live parts of electric equipment operating at 50 volts or more shall be guarded against accidental contact by use of approved cabinets or other forms of approved enclosures or by any of the following means:      a.  At the work site located at 1685 Woodland Avenue, Columbus, Ohio, employees entered the shop area daily and used a light switch with a broken cover and exposed wiring to turn on the shop lights.  The employer had not ensured that the live parts of the light switch were guarded to prevent employee exposure to the live parts inside.

29 CFR 1910.1200(e)(1): 29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a.  At the work place, employees who welded and assembled custom racks and exercise equipment used welding gases, propane for the fork lift truck, and cleaners to prepare and finish metals that included (but were not limited to) Goof Off, Simple Green, Sunnyside acetone, Chlorox cleaners with bleach, hydraulic fluid, acrylic crack filler, Loctite PL200 Construction adhesive, high gloss spray paint and Hi-Strength Spray Adhesive.  The employer did not have a written hazard communication program for employees.

29 CFR 1910.1200(g)(8): The employer shall maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and shall ensure that they are readily accessible during each work shift to employees when they are in their work area(s). (Electronic access and other alternatives to maintaining paper copies of the safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.)  a.  At the work place, employees used cleaners that included (but were not limited to) welding gases, propane Goof Off, Simple Green, Sunnyside acetone, Chlorox cleaners with bleach, hydraulic fluid, acrylic crack filler, Loctite PL200 Construction adhesive, high gloss spray paint and Hi-Strength Spray Adhesive.  The employer did not have Safety Data Sheets for any of the chemicals used by employees at the work site.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets.  a.  At the work place, the employer had not trained employees about the hazardous chemicals being used during welding and assembling of custom racks and exercise equipment.  Employees used welding gases, propane for the fork lift truck, and cleaners to prepare and finish metals that included (but were not limited to) Goof Off, Simple Green, Sunnyside acetone, Chlorox cleaners with bleach, hydraulic fluid, acrylic crack filler, Loctite PL200 Construction adhesive, high gloss spray paint and Hi-Strength Spray Adhesive.
