29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a. On or about January 21, 2015, at the east side of the building, the job-made wooden ladder used by employees to access the roof had side rails that only extended 1 feet above the landing surface, exposing employees to a 9ft.-8in. fall hazard.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired: a. On or about January 21, 2015, at the east side of the building, the job-made wooden ladder used by employees to access the roof was structurally defective in that the cleats were attached to the rails with only 2 nails instead of 3, and it was missing the filler blocks between the cleats, exposing employees to a 9ft.-8in. fall hazard.
