29 CFR 1910.1026(l)(1)(iii): Employers shall include chromium (VI) in the hazard communication program established to comply with the HCS (Sec. 1910.1200). Employers shall ensure that each employee has access to labels on containers of chromium (VI) and to safety data sheets, and is trained in accordance with the requirements of HCS and paragraph (l)(2) of this section: On or about January 26, 2015, at the welding shop, employees required to weld (TIG) stainless steel were exposed to the hazard of contact with chromium (VI). The employer did not include chromium (VI) in the hazard communication program, including, maintaining safety data sheets and employee training in accordance with the requirements of HCS (Sec. 1910.1200) and paragraph (l)(2) of this section.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets: On or about January 26, 2015, at the welding shop, employees required to weld (TIG) stainless steel were exposed to the hazard of contact with chromium (VI). Employees were not provided with effective information and training on chromium (VI), including: (i) Health hazards of chromium (VI) (ii) Safety Data Sheets (iii) Measures employees can take to protect themselves (i.e. local exhaust ventilation).

29 CFR 1910.147(c)(6)(i): The employer shall conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed: On or about January 26, 2015, in the facility, maintenance employees required to service and maintain machines and equipment, including, but not limited to, toppers, wrappers and freeze tunnels, were exposed to the potential hazard of unexpected energization or start up of the machines and equipment. The employer did not conduct a periodic inspection of the energy control procedures at least annually to ensure that the procedure and the requirements of the standard were being followed. Aryzta LLC was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 920696, citation number 1, item number 3 and was affirmed as a final order on October 23, 2013, with respect to a workplace located at 64 Chester Street, Rochester, NY 14611.
