29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):     (a)Summers Construction, Inc. @ 4055 North Albion Street, Denver, CO: On and before January 22nd, 2015, the exposing employer did not ensure each employee working inside an excavation was protected from cave-in. The West wall measuring 7'6" deep was excavated in a near vertical configuration. The west wall lacked an adequate protective system, such as appropriate sloping, benching, or shield systems. This condition exposed an employee to hazards associated with cave-in hazards.    (b)Summers Construction, Inc. @ 4055 North Albion Street, Denver, CO: On and before January 22nd, 2015, the exposing employer did not ensure each employee working inside an excavation was protected from cave-in. The South wall measuring 7'-6" deep lacked appropriate benching contrary to subpart P, Figure B-1.2 for type B soil. This condition exposed an employee to hazards associated with cave-in hazards.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres and or other hazardous conditions:     (a) Summers Construction, Inc. @ 4055 North Albion Street, Denver, CO:  On and before January 22nd, 2015, the exposing employer did not ensure daily inspections of an excavation measuring approximately 7'-6" in depth were made by a competent person for evidence of a situation that could have resulted in cave-in.  A competent person did not ensure an adequate protective system was utilized prior to entry. The West side of the excavation was sloped at an angle greater than 45 degrees. This condition exposed employee(s) to potential crushing hazards associated with cave-in.     (b)Summers Construction, Inc. @ 4055 North Albion Street, Denver, CO:  On and before January 22nd, 2015, the exposing employer did not ensure daily inspections of an excavation measuring approximately 7'-6" in depth were made by a competent person for evidence of a situation that could have resulted in cave-in.  A competent person did not ensure an adequate protective system was utilized prior to entry. The South side of the excavation was benched at an angle greater than 45 degrees. This condition exposed employee(s) to potential crushing hazards associated with cave-in.     Abatement Note: "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
