OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crush and amputation hazards: a) House #13 - On or about 01/26/15 and at times prior thereto the feed cart did not have emergency stop devices installed and accessible to the workers in case of an emergency. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall hazards: a) House #13 - On or about 01/26/15 and at times prior thereto employees climbed and stood on the lower rail of the Facco feed cart in order to access the higher cages. The employer did not provide a safe, stable working surface to prevent the fall of employees onto the concrete floor. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed: a) Facility - On or about 01/26/15 and at times prior thereto employees applied lockout/tagout and performed repairs/maintenance of the equipment operating in House #1 to House #13, and the cooling and grading facilities. The employer did not conduct audits/inspections of each individual lockout/tagout procedure. 29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, and rotating parts: a) House #13 - On or about 01/26/15 and at times prior thereto employees approaching the cages were not protected from crush and amputation hazards created by the horizontal displacement of the feed cart in close proximity of the fixed structural components of the cages and frames. b) House #13 - On or about 01/26/15 and at times prior thereto employees approaching the cages were exposed to amputation hazards created by the unguarded wheels (casters) and rails supporting the feed cart. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
