OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Employees were exposed to falls from step ladders.  A.  At this worksite, an employee worked from a six foot portable "A" frame fiberglass ladder;  the ladder was folded closed and leaning against a tree. Employees were exposed to a fall hazard.  B.  At this worksite, an employee worked from a six foot portable "A" frame fiberglass ladder;  the top step of the ladder was utilized for access.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):  At this work site  employees were engage in the removal of light strands as used during the holidays season. Three employees were working in trees at heights of approximately 7-10 feet from ground level without fall protection.
