29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.     The employer does not ensure that the side rails on portable ladders used for access to an upper landing surface were extended at least 3 feet above the upper landing surface being accessed.  This violation was observed on or about January 26, 2015 at a residential home construction site, on the east side of the structure,  where an employee was exposed to a fall hazard when accessing the roof with a ladder without the ladder's rails extend at least 3 feet above the landing surface.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the side rails on portable ladders used for access to an upper landing surface were extended at least 3 feet above the upper landing surface being accessed.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    The employer does not ensure that each employee engaged in residential construction activities 6 feet or more above lower levels are protected by guardrail systems, safety net systems, or personal fall arrest systems.  This violation was observed on or about January 26, 2014, on the southeast side of the residential home where an employee was exposed to a fall hazard greater than 6 feet when installing shingles without a fall protection system.    The Arnulfo Rodriguez Roofing Co., Inc. dba Rodriguez Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13) which was contained in OSHA inspection number 1000091, citation number 1, item number 1, and was affirmed as a final order on November 14, 2014 with respect to a workplace located at 12418 Garden Gale Ln., Houston, TX  77044.    The Arnulfo Rodriguez Roofing Co., Inc. dba Rodriguez Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13) which was contained in OSHA inspection number 985018, citation number 2, item number 1, and was affirmed as a final order on  August 18, 2014 with respect to a workplace located at 1934 Parnevik Place, Houston, TX  77066.    The Arnulfo Rodriguez Roofing Co., Inc. dba Rodriguez Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13) which was contained in OSHA inspection number 980872, citation number 1, item number 1, and was affirmed as a final order on July 28, 2014 with respect to a workplace located at 6511 Bayliss Valley Lane, Katy, TX  77449.    The Arnulfo Rodriguez Roofing Co., Inc. dba Rodriguez Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13) which was contained in OSHA inspection number 980869, citation number 1, item number 1, and was affirmed as a final order on July 28, 2014 with respect to a workplace located at 6515 Bayliss Valley Lane, Katy, TX  77449.    Robert Rodriguez Roofing, also known as Arnulfo Rodriguez Roofing Co., Inc. dba Rodriguez Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 960351, citation 1 item 1 and was affirmed as a final order on March 7, 2014, with respect to a workplace located at 3003 Meadow Prairie St., Katy Texas 77494      Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees engaged in residential construction activities 6 feet or more above lower levels are protected by guardrail systems, safety net systems, or personal fall arrest systems.
