29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. On or about 28 January 2015, the rotating chuck on the Powermatic drill press, and the Rockwell drill press was not guarded exposing employees to hazards such as those created by being caught in between the point of operation and the material.

29 CFR 1910.178(l)(6):The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l), with certification records that includes the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation. On or about 2 February 2015, employees who were trained and evaluated to operate powered industrial trucks (forklifts); among them, the Toyota forklift, and the Nissan forklift were not certified by the employer.
