On or about January 28, 2015 - at the above addressed jobsite, the employer did not maintain an accident prevention program and/or safety and health program to comply with the regulations of this part which included, but were not limited to employee protection when exposed to falls.

29 CFR 1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.    a. On or about January 28, 2015 - at the above addressed jobsite, the employer failed to provide a written certification record of training for each employee exposed to fall hazards.

29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as follows:    a. On or about January 28, 2015 - at the above addressed jobsite, the anchor used for attachment of personal fall arrest equipment was installed in such way that it would not support at least five thousand (5,000) pounds, thereby exposing the employee to a fall hazard.

THE APEK INCORPORATED WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(b)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 941707, CITATION NUMBER 2, ITEM NUMBER 1 AND WAS AFFIRMED AS FINAL ORDER ON MARCH 11, 2014, WITH RESPECT TO A WORKPLACE LOCATED AT 911 S.
