29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided:    (a)    All In One Professional Brothers LLC at 2550 Custer Drive, Unit C, Fort Collins, CO 80525:  On and before January 27, 2015, the exposing employer did not ensure each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system in that approximately twelve employees were engaged in tearing off an old roof and applying a new roof on a single story apartment complex.  This condition exposed the employees to a fall hazard of approximately 10 feet.

29 CFR 1926.502(d)(16):  Personal fall arrest systems, when stopping a fall, shall be rigged such that employees can neither free fall more than 6 feet, nor contact any lower level:     (a)   All In One Professional Brothers LLC at 2550 Custer Drive, Unit C, Fort Collins, CO 80525:  On and before January 27, 2015, the exposing employer did not ensure that the personal fall arrest systems used by two employees limited the fall distance to 6 feet, nor prevented contact with the lower level.  Two employees engaged in roofing activities were wearing fall harnesses attached to anchored vertical lifelines; however, their rope grabs and lanyards were missing resulting in their fall protection systems not providing fall protection.  Conditions resulted in employees exposed to fall hazards of greater than 6 feet, and with high potential of contacting the ground below at approximately 10 feet below.

29 CFR 1926.503(a)(2): The employer did not assure that each employee had been trained by a competent person qualified in the standards contained in subpart M:     (a)  All In One Professional Brothers LLC at 2550 Custer Drive, Unit C, Fort Collins, CO 80525:  On and before January 27, 2015, the exposing employer did not ensure that each employee who is exposed to fall hazards had been trained by a competent person, in that approximately twelve employees were exposed to fall hazards greater than six feet associated with roofing activities on a single story apartment comples while using personal fall arrest systems incorrectly.  This condition exposed the employees to a fall of approximately 10 feet to the ground below.     Abatement Note:  1926.503(b)(1) provides that the employer shall verify compliance with paragraph 1926.503(a) by preparing a written certification record, which shall contain the name of the person being trained, the dates of training, and the signature of the person who conducted the training, or the signature of the employer.  If the employer relies on training conducted by another employer, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of the actual training.     Abatement Note:  The competent person shall be qualified in the following areas:     (1)  The nature of fall hazards in the work area;     (2)  The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;     (3)  The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;     (4)  The role of each employee in the safety monitoring system when this system is used;     (5)  The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs;     (6)  The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection;     (7)  The role of employees in fall protection plans;     (8)  The standards contained in this subpart.
