Section 5(a)(l) of the Occupational Safety and Health Act of 1970: The employer did not furnish  employment and a place of employment which were free from recognized hazards that were causing  or likely to cause death or serious physical harm to workers, in that the workers were exposed to  hazards of falling from heights and struck-by hazards    The employer failed to ensure that the free standing tower section had the strength and structural integrity to support employees safely.  Two employees were working on one side of the free standing tower section when the section fell over resulting in serious injury to both employees.  The tower section was not supported by any means and the wind gusts the day of the incident were in excess of 30 mph.  The area was in a wind advisory at the time of the incident.
