OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 SECTION (5)(a)(1): The employer did not furnish employment and  a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and crushing hazards:   Employees working on the ground floor of the grain elevator were exposed to struck-by and crushing hazards.  The manlift entrance was not protected to prevent employees from being stuck-by or crushed by the manlift cage.  Among one feasible and acceptable method of abatement would be to install a gate that would extend from the floor up to the top of the opening. The American Society of Mechanical Engineers (ASME) A17.1 Safety Code for Elevators and Escalators (2010) paragraph 2.11.1.1 Hoistway Landing Entrances. All elevator hoistway landing openings shall be provided with entrances that shall guard the full height and width of the openings. Entrances shall be at least 2.030mm (80 in.) in height and 800 mm (31.5 in.) in width.

29 CFR 1910.27(c)(1): On fixed ladders, the perpendicular distance from the centerline of the rungs to the nearest permanent object on the climbing side of the ladder was not 36 inches for a pitch of 76 degrees, and 30 inches for a pitch of 90 degrees with minimum clearances for intermediates pitches varying between these limits in porportion to the slope, except as provided in subparagraphs (3)(and (5) of this paragraph:  Employees climbing the fixed ladder in the concrete grain elevator were exposed to fall hazards of 11 feet to the concrete floor below.  The ladder from the bin deck level to the motor platform had a grain spout blocking the path of travel.

The drive pulleys for the following machines were not guarded on the back side:  a) Bulk Dry fertilizer drive pulley for the auger b) Drag conveyer on the roof of the concrete grain elevator drive pulley.

29 CFR 1910.272(j)(2)(i)(A): The employer's priority housekeeping program for grain elevators did not include floor areas within 35 feet (10.7m) of inside bucket elevator(s):     Employees performing grain elevator operations were exposed to fire and explosion hazards.  Combustible dust was found in excess of 1/8 of an inch at the following locations:  a) Bin Deck Level of the grain elevator.  Dust on the floor measured 3/4 of an inch. b) Boot Pit of the grain elevator.  Dust measured 1/4 of an inch on top of the bucket elevator casing.
