29 CFR 1910.178(p)(1): A powered industrial truck was found to be in need of repair, defective, or in any way unsafe, the truck and was not be taken out of service until it had been restored to safe operating condition. 1/29/2015, an employee was operating an unsafe powered industrial truck and another forklift was in need of repair and not removed from service. The following forklifts were on site and not removed from service: a) Nissan #50 was in operation. The LPG tank was not properly placed on the indexing pin to prevent a LPG release. b) Nissan #60 did not have any covers on the pedals to prevent operators feet from slipping off while in operation. The paint was worn of and bare metal exposed.

Component Bar Products, Inc. had not examined powered industrial trucks daily. Two forklifts needed maintenance. Nissan forklift #50 had an improperly installed LPG tank and Nissan forklift #60 had bare metal on the operators pedals. Neither forklift had defects identified nor had the forklifts been removed from service.

29 CFR 1910.215(b)(9): Exposure adjustment. Safety guards of the types described in Subparagraphs (3) and (4) of this paragraph, where the operator stands in front of the opening, were not constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel. The maximum angular exposure above the horizontal plane of the wheel spindle as specified in paragraphs (b)(3) and (4) of this section were exceeded, and the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top exceeded one-fourth inch. On 1/29/2015, an employee from Component Bar Products, Inc. was exposed to struck-by hazards. The tongue guard on a Sunex Tools 8 inch pedestal grinder, Model 5002A, was not adjusted to one-fourth inch.
