OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) In the facility yard, on or about January 27, 2015 and at times prior to, employees performing manual movement of converter dollies were exposed to struck-by hazards while the employer did not ensure that converter dollies were positioned by mechanical means in preparation for trailer assembly and following disassembly.

29 CFR 1910.178(a)(4): Modifications or additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: (a) In the yard area of the facility, on May 13, 2015 and at times prior to, the employer allowed employees to move converter dollies by the use of an in-house, fabricated forklift attachment (fork sheath and hook) without seeking the approval of the forklift manufacturer.
