29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminants' chemical state and physical form: (a) Summit Energy Services, Inc. at WPX well pad GM 13-33, Parachute, CO 81505: On and before January 9th, 2015, the employer did not identify and evaluate the respiratory hazards in the workplace. Employees opened thief hatches to strap and verify tank levels. Flammable hydrocarbon gases were vented through open thief hatches. No 4-gas meters or similar gas-detection devices were used to identify and evaluate respiratory hazards. The employer did not evaluate employee exposure to respiratory hazards, including oxygen deficient atmospheres and hydrocarbon gases and vapors, including but not limited to propane, butane, and benzene. This condition exposed employees to respiratory hazards. (b) Summit Energy Services, Inc. at WPX well pad GM 13-33, Parachute, CO 81505: On and before January 9th, 2015, the employer did not identify and evaluate the respiratory hazards in the workplace. Employees worked around tank batteries containing hydrocarbon gases. Flammable hydrocarbon gases could be present onsite in the event of a release. The employer did not evaluate employee exposure to respiratory hazards, including oxygen deficient atmospheres and hydrocarbon gases and vapors, including but not limited to propane, butane, and benzene. This condition exposed employees to respiratory hazards.

29 CFR 1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used: (a)Summit Energy Services, Inc. at WPX well pad GM 13-33, Parachute, CO 81505: On and before January 9th, 2015, employees responsible for strapping tanks and hauling production water were exposed to health and fire hazards from hydrocarbon gases being vented through open thief hatches on production water tanks. The employer had not provided employees with appropriate training which included the use of 4-gas meters or similar monitoring equipment to detect potential oxygen deficient atmospheres and excessive levels of hydrocarbon gases being vented through open thief hatches. This condition exposed employees to chemical exposure hazards. Abatement Note: Among other methods, feasible abatement methods include: - Installation and use of ground level tank gauges to eliminate the need for employees to climb onto tanks to perform tank gauging. Refer to American Petroleum Institute Manual of Petroleum Measurement Standards Chapter 3.1B "Standard Practice for Level Measurement of Liquid Hydrocarbons in Statationary Tanks by Automatic Tank Gauging".
