OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a tip-over hazard:   a) This violation occurred on or about January 23, 2015, at a workplace located at Tyler Jr. College Residence Hall, 1250 Magnolia Drive, Tyler, TX; where an employee working from the elevated basket of a Genie aerial lift was exposed a tip-over hazard. The aerial lift was being operated on soft ground from rain and in an area adjacent to an excavation.
