29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.  The employer does not protect employees from a possible danger of head injury from impact, or falling or flying objects by protective helmets.  This violation was observed on or about February 2, 2015, at the job site where an employee was exposed to a stuck-by hazard from falling bricks while working under a scaffold during masonry work on a residential structure without out a protective helmet.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, are protected by protective helmets.

29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.  For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall.  The employer does not protect employees from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects. This violation was observed on or about February 2, 2015, at the job site where an employee was exposed to a stuck-by hazard from falling objects while working under a scaffold during brick work on a residential structure without out a protective helmet.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees are protected from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed.  The employer does not ensure that portable ladders are used for the purpose in which they are designed. This violation occurred on or about February 2, 2105, at the jobsite where an employee was exposed to a fall hazard when using a 5- foot A-frame step ladder to gain access to the scaffold for which it was not designed.   Pursuant to 29 C.F.R. 1903.19, within one (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all ladders used by employees are used for the purpose for which they were designed.

Gertrudis Rios DBA Rios Bricklaying Contractors, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(b)(2), which was contained in OSHA inspection number 1013471, citation number 1, item number 2 and was affirmed as a final order on January 7, 2015, with respect to a workplace located at 1860 Leela Springs Dr, Conroe TX 77304.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees work from scaffold platforms that are at least 18 inches wide.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Cross braces were used as a means of access.  The employer does not ensure that employees have a ladder, stairway, or ramp to access a scaffold.  This violation occurred on or about February 2, 2015 when employees were exposed to a fall hazard while doing masonry work from the second level of a scaffold without adequate access. Gertrudis Rios DBA Rios Bricklaying Contractors, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(e)(1), which was contained in OSHA inspection number 1013466, citation number 1, item number 1 and was affirmed as a final order on January 7, 2015, with respect to a workplace located at 1824 Leela Springs Dr, Conroe TX 77304.
