Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to falls from being lifted on the forks of the forklift:    a)  Warehouse - On or about February 4, 2015, employees were being raised on the forks of the Raymond High reach forklift and Clark forklift to access the upper level of the racking system.    Among other methods, a feasible and acceptable means to abate these hazards is to follow ITSDF B56.1-2005 entitled, "Safety Standard for Low Lift and High Lift Trucks," Section 4.17 Elevating Personnel, which states, "Only operator-up high lift trucks have been designed to lift personnel.  If a work platform is used on trucks designed and intended for handling materials, the requirements of paragraphs 4.17.2 and 4.17.3 shall be met for the protection of personnel."

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees are exposed to rack collapse from damage and unsecured to the storage racking system posts.    a)  Warehouse - On or about February 4, 2015, storage rack posts are damaged from being struck by forklifts and not taken out of service and repaired.    b)  Warehouse - On or about February 4, 2015, storage rack legs are not secured to the floor with bolts to prevent displacement.    Among other methods, a feasible and acceptable means to abate these hazards is to follow ANSI Ng16,1-2008 entitled, "Specification for the Design, Testing, and Utilization of Industrial Steel Storage Racks," Section 1.4.7, Column Base Plates, which states "The bottom of all columns shall be furnished with column base plates, as specified in Section 7.2.  All rack columns shall be anchored to the floor with anchor bolts capable of resisting the forces caused by the horizontal and vertical loads on the rack and Anchors," and 1.4.9, Rack Damage, which states "Upon any visible damage, the pertinent portions of the rack shall be unloaded immediately by the user until the damaged portion is repaired or replaced."

A safe place to ride shall be provided where riding of trucks is authorized.    a)  Warehouse - On or about February 4, 2015, employees were riding upon and being raised by the forks of the Raymond High reach forklift and Clark forklift to access the upper level of the racking system without being provided a proper lifting platform or place to ride.
