29 CFR 1910.23(a)(8): Every floor hole into which persons can accidentally walk shall be guarded by a floor hole cover of standard strength and construction: On or about February 4, 2015, in the facility, employees required to perform liquid chemical batching/mixing at the #2 Liquid Tank were exposed to a trip hazard due to an approximate 17" x 10" floor hole. The floor hole was not guarded by a floor hole cover of standard strength and construction.

29 CFR 1910.134(f)(2): The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter: On or about February 4, 2015, in the facility, employees required to perform dry and liquid chemical batching/mixing operations wore half-mask or full-face air-purifying respirators. The employer did not ensure that each employee required to use a tight-fitting respirator was fit tested prior to initial use of the respirator and at least annually thereafter.

29 CFR 1910.134(c)(2)(ii): The employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks): On or about February 4, 2015, in the facility, employees required to perform dry or liquid chemical batching/mixing operations were provided with tight-fitting half-mask and full-face air-purifying respirators for voluntary use. The employer did not ensure that any employee using a respirator voluntarily was medically able to use that respirator.
