OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and  a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards:  Frequent and periodic inspections (monthly and annually) were not performed on the 3-Ton Demag; 5-Ton Gaffey; and 2-Ton Coffing hoists.  Employees were exposed to struck-by hazards associated with falling loads and/or an overloaded hoist.  Among other methods, one feasible and acceptable abatement method is:    Perform frequent and periodic inspections as required by ASME B30.16-2007 - OVERHEAD HOISTS, Section 16-2.1.2 and 16-2.1.3.  Inspections include, but are not limited to, controls and operating mechanisms for improper operations; safety devices for malfunction; deterioration or leakage in air systems; and, deformations, chemical damage, or cracks in hook.

29 CFR 1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or  were not packed or stored to prevent deformation of the face-piece and exhalation valve:  Paint area - Employees were exposed to inhalation and hygiene illnesses in that 3 of the 3M respirators were not stored in a sanitary manner. The respirators were left lying on a work/part cart.  29 CFR 1903.19(c)(2) abatement of the above violation was verified at time of inspection, no certification is required.

29 CFR 1910.134(k)(1)(v): The employer did not ensure that each user could demonstrate knowledge of the procedures for respirator maintenance and storage:  Paint area - Employees using 3M respirators were exposed to inhalation, hygiene illnesses and chemical absorption hazards in that a Respiratory Protection Training Program was not effective. Employees engaged in respirator operations without procedures for storing, and otherwise maintaining the respirator. Three (3) of the 3M respirators were left on a work/part cart, exposed to sun, dust, damages.   29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.

29 CFR 1910.303(g)(1)(i): The dimension of the working space in the direction of access to live parts operating at 600 volts or less and likely to require examination, adjustment, servicing, or maintenance while alive was less than indicated in Table S1:  Employees were exposed to electrical shock and fire hazards at the following in that sufficient access and working space was not provided and maintained about electric equipment to permit ready and safe operation and maintenance of such equipment:  a) Test Bay area - The test grills and wooden pallets were blocking the disconnect switch, 230V single phase, use to energize the smoker test station process, thus preventing employees from accessing the safety switch in case of an emergency or to perform any service. b) Machine Shop area - The containers, broom, metal cart and wooden pallet were blocking the disconnect switch, use to energize the Okuma CNC machine, thus preventing employees from accessing the safety switch in case of an emergency or to perform any service.  29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.
