29 CFR 1926.20(b)(3): Machinery, tool(s), material(s), or equipment which was not in compliance with the applicable requirement(s) of 29 CFR 1926 was not prohibited, and/or was not either identified as unsafe by tagging, or locking the controls to render them inoperable, or physically removed from its place of operation: (a) At the worksite - Employees used a Stihl Cutoff Machine with a carbide tipped rescue blade to cut wood stringers from the boardwalk at Rockaway Beach. The saw kicked back and struck and employee in the face; on or about 02/05/15. One feasible means of abatement is to use the appropriate tool to cut wood such as a chain saw with kickback protection. The manufacture states this cut-off machine is not for cutting wood and does not recommend the use of a carbide tipped blade, a rescue blade or any part not made for the machine. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $ 1,000.00 AS PER 29 CFR 1903.19.
