OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm including injuries from crushing or tip over of manually propelled storage carts/racks to employees in that employees were exposed to crush by hazards from storage carts/racks being top heavy and tip over prone when loaded with automotive parts weighing approximately 700 to 800 pounds. a) Warehouse and shipping area: On or about December 11th, 2014, and prior to, the employer exposed employees to crushing hazards and injuries from manually propelled automotive parts storage carts/racks that were top heavy and tip over prone when loaded with parts.
