29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.   a) Jobsite: Employees performing stucco operations from the 5th level of the fabricated frame scaffolding were exposed to fall hazards of approximately thirty-two (32) feet without the use of personal fall arrest systems or guardrail systems. Observed on or about January 15, 2015.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  a) Jobsite: Employees working on a fabricated frame scaffold were not trained by a person qualified to recognize, control, or minimize hazards associated with scaffolds. Observed on or about January 15, 2015.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Windows and scaffold frames were used as a means of access.  a) Jobsite: Employees were not provided with a safe means of access and/or egress to the working platforms of a fabricated frame scaffold, exposing employees to a fall hazard of approximately thirty-two (32) feet.  Employees were using the side frame of the scaffold to access and/or egress the working levels. Observed on or about January 15, 2015.

29 CFR 1926.451(c)(1)(ii): Guys, ties, and/or braces were not installed  according to the scaffold manufacturer's recommendations or at the closest horizontal member to the 4:1 height and repeated vertically at locations of horizontal members every 20 feet (56.1 m) or less thereafter for scaffolds 3 feet ((0.91 m) wide or less, and every 26 feet (7.9 m) or less therafter for scaffolds greater than 3 feet (0.91m) wide.  a) Jobsite: A fabricated frame scaffold with a height to base ratio of more than four to one (4:1) was not restrained from tipping by guying, tying or bracing.  Employees were applying stucco on the 5th working level, approximately 32 feet above ground level. Observed on or about January 15, 2015.
