29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:     Workers were engaged in commercial construction activities installing 18 inch, SDR-35 sanitary sewer pipe. Workers were exposed to cave-in and other hazards associated with trenching construction operations in that the workers were not properly trained in safe trenching operations criteria.

Worker(s) were exposed to potential struck-by hazards in that workers were not utilizing proper personal protective equipment (vests).

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:       Located off St. Rt. 139 Minford, Ohio worker(s) were engaged in commercial construction activities, installing a new pump station, #11, and pertinent piping in a 8.5 foot deep excavation/trench. Workers were exposed to potential cave-in hazards and a proper means of access and egress was not provided.       The Tri-State Pipeline, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 987393 citation number1, item number 2, and was affirmed as a final order on September 17, 2014 with respect to a workplace located in Minford, Ohio.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:       Located off St. Rt. 139 , Minford, Ohio worker(s) were engaged in commercial construction activities installing a new pump station, #11, and necessary piping in a 9.0 deep excavation/trench. Workers were exposed to potential cave-in hazards and a proper inspection of the jobsite was not conducted by a competent person to identify; a lack of proper means of access and egress,  workers working outside of the trench box and workers not utilizing proper personal protective equipment (vests).       The Tri-State Pipeline, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(k)(1), which was contained in OSHA inspection number 987393, citation number 1, item number 3 and was affirmed as a final order on September 17, 2014 with respect to a workplace located in Minford, Ohio.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).      Issue 1- On or about February 4, 2015, located off Rt. 139, Minford, Ohio, (Excavation/Trench #1) workers were installing a new pump station #11 and pertinent pipelines.  Workers were observed working in the unprotected area of a 9.0 deep foot excavation/trench, exposed to cave-in hazards without utilizing a proper cave-in protection system.     Issue 2-On or about February 3, 2015, located along Dodge Street, Minford, Ohio, between manholes 69A and 71, (Trench #2),worker(s) were engaged in commercial construction activities installing a lateral 4.0 inch sanitary sewer pipe in a 9.0 deep trench. Worker(s) were exposed to potential cave-in hazards in that a cave-in protection system was not utilized.    Issue 3- On or about February 4, 2015, located along Rt. 139, Minford, Ohio,  at manhole 324,  (Trench #3) worker(s) were observed working in the unprotected area of a 9.0 deep foot trench, exposed to cave-in hazards in that a cave-in protection system was not properly utilized.       The Tri-State Pipeline, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA inspection number 987393, citation number 1, item number 4 and was affirmed as a final order on September 17, 2014, with respect to a workplace located in Minford, Ohio.
