Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee in that employees were exposed to injuries related to tip over of an aerial lift: a) On or about 02/03/15 at 1400 Federal Blvd., Carteret, NJ 07008 an employee was operating a JLG 1350SJP aerial lift owned by Sunbelt Rentals. The employee was exposed to hazards associated with tip over hazards when he overrode the safety devices to enable the tires to turn, had the extendable axles partially extended on one side and extended the boom approximately 30 feet vertically as he rotated the turntable almost 90 degrees from the stowed position.
