29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: (a) On or about February 5, 2015, and at certain times before, employees working in the sanitation department were exposed to serious injuries, including amputations, while performing sanitation work on industrial meat processing machinery, including but not necessarily limited to the Cozzini meat blender described by the company as "Blender 1, Tunnel 1", due to inadequacies in machine-specific lockout/tagout procedures. Abatement certification is required for this Item. Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedures and the requirements of this standard were being followed: (a) On or about February 5, 2015, and at certain times before, employees working in the sanitation department were exposed to serious injuries, including amputations, while performing sanitation work in that numerous annual reviews of the energy control procedures failed to ensure that the 29 CFR 1910.147 requirements were being met. The employer had documents evidencing the completion of the required annual LOTO program reviews, but the reviews failed to detect program deficiencies including, but not necessarily limited to, recognizing the installation of a secondary safety interlock system on a meat blender described by the company as "Blender 1, Tunnel 1" and other similarly modified machines. Abatement certification is required for this Item. Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, or flying chips and sparks: (a) On or about February 5, 2015, and at certain times before, employees working in the production areas of the plant were exposed to serious hazards, including amputations, while working with and around industrial meat processing machines that had been modified to accept vats in lieu of hoppers to catch processed meat being expelled from the machines. These modifications removed the physical barricades afforded by the hoppers and exposed employees to severe pinch point hazards caused by rotating paddles crossing the discharge door openings of the machines when vats were used in lieu of the hoppers. Abatement certification is required for this Item. Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.
