29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel:    a) Facility - On or prior to February 6, 2015, the Caterpillar (Model: DP70, Serial No. 9CP00773, Truck No. 39) power-operated industrial truck  had a backup alarm that was not working, faulty fuel and temperature gauges, a horn that was not working, head and tail lights that were not working, hydraulic leaks, transmission leaks, windshield wipers that were not working, and a broken glass window.  The power-operated industrial truck was not taken out of service.    The Mid-State Lumber Corp. of New York was previously cited for a violation of this occupation safety and health standard or its equivalent standard, which was contained in OSHA inspection number 313763377, citation number 1, item number 3 and was affirmed as a final order on 6/10/11, with respect to a workplace located at 270 Kings Highway, Warwick, NY 10990.
