29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel.  a.  At the work site, the employer provided a Komatsu and a Nissan fork lift truck for employees to move delivered, stored and packaged materials for shipping.  At the time of inspection, the back up alert on the Komatsu fork lift truck did not work and the employer had not removed it from service.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.  a.  At the work site, the employer had employees who worked with recycled metals use a Cram-a-Lot compactor/baler to compress metal into bales for shipment.   The Cram-a-Lot compactor/baler, Model number 60 CONT Serial number 2755, was not adequately guarded in that, during operation, the interlock system did not work, allowing the gate to be open during operation and exposing employees to a caught-in hazard from the downward-moving piston.  b.  At the work site, the employer had employees who worked with recycled metals use a General Hydraulics compactor/baler to compress metal into bales for shipment.   The General Hydraulics compactor/baler, Model number 314-6OR-11 Serial number 4050, was not adequately guarded in that, during operation, a two inch gap at the bottom of the gate exposed employees to an caught-in hazard from the downward-moving piston.

29 CFR 1910.212(a)(3)(iv): The following are some of the machines which usually require point of operation guarding:  29 CFR 1910.212(a)(3)(iv)(c): Alligator shears.   a.  At the work site, the employer had employees use an alligator shear to cut large pieces of recycled metal into smaller pieces for ease in handling.  The guard on the shear had been damaged, causing it to break off of the shear, and had not been replaced while employees continued to use the shear.
