General-duty citation text
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire, deflagration and explosion hazards. The most recent example of this was found on the job site located at 6040 Fletcher Ave, Lincoln, NE 68507 where the employer has employees working on the rolling grinding stations using un-bonded 2.5 PVC pipe as part of the ventilation system, creating the potential for static charge to build up as product passes through the PVC and increase the possibility of sparking the dust and creating a deflagration ultimately leading to a secondary combustible dust explosion. Among other methods, feasible and acceptable methods of abatement are: Replace the electrically non-conductive PVC pipe with an electrically conductive duct work.
