29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: (SEE CONSTRUCTION REFERENCE 1926.103) a) On or about February 10, 2015- job site at 61-35 Junction Blvd, Rego Park, NY 11374 Employer permitted their employees to voluntarily wear N95 type respirators while engaged in floor scrapping prior to tile installation. Employer failed to provide the employees with appendix D of 29 CFR 1910.134 as required. WRITTEN ABATEMENT CERTIFICATION IS REQUIRED.
