29 CFR 1910.1000(c): An employee(s) was exposed to silica in excess of the 8-hour time weighted average limits listed in Table Z-3:    a) Grout Department: The mixing operator was exposed to silica (respirable dust) from elevated concentrations at an 8 hour time weighted average (TWA) of 4.58 mg/m3, which was 2.79 times the permissible exposure limit (PEL) of 1.639 mg/m3. The exposure level was derived from a sample collected over a 415 minute sampling period on 2/18/15. Zero exposure assumed for the 65 minutes not sampled.     b) Grout Department: The mixing operator was exposed to silica (respirable dust) from elevated concentrations at an 8 hour time weighted average (TWA) of 2.19 mg/m3, which was 3.72 times the permissible exposure limit (PEL) of 0.588 mg/m3. The exposure level was derived from a sample collected over a 389 minute sampling period on 2/18/15. Zero exposure assumed for the 91 minutes not sampled.      c) Grout Department: The mixing operator was exposed to silica (respirable dust) from elevated concentrations at an 8 hour time weighted average (TWA) of 1.42 mg/m3, which was 2.41 times the permissible exposure limit (PEL) of 0.588 mg/m3. The exposure level was derived from a sample collected over a 379 minute sampling period on 2/18/15. Zero exposure assumed for the 101 minutes not sampled.

29 CFR 1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d):    a) Grout Department: The employer did not develop and implement appropriate engineering controls to reduce employee exposure to silica at or below the permissible exposure limit (PEL).    General methods of controls applicable in these circumstances include, but are not limited to the following:     1. The employer should consider measuring the effectiveness of the existing dust collection system and improving the system to effectively remove total dust from the air.   2. The employer should consider evaluating the power coating process to improve the application of the power and decrease the amount of overspray.   3. Train employees on proper work practices such as not positioning themselves between the work and the dust collection system.  4. Enforce good housekeeping. Do not dry sweep or use compressed air because this re-suspends the dust in the air and increases worker exposure.    However, other methods of abatement may be equally, or more appropriate. Ultimate responsibility for determining the most appropriate abatement method rests with the employer, given its superior knowledge of the specific conditions at its worksite.
