29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use.  On or about February 11, 2015, and at times prior thereto, employees were overexposed to crystalline silica during the grinding of granite, and not protected by employer through establishing and implementing a written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i)-(ix) with worksite specific procedures required for respirator use.  This condition exposed employees to health hazards.

29 CFR 1910.243(c)(1): Abrasive wheel(s) were used on portable grinder(s) which were not provided with safety guard(s) meeting the requirements specified in 29 CFR 1910.243(c)(1) through (c)(4)(a)   On or about February 11, 2015, and at times prior thereto, employees were using Makita 9565CV 5 inch electrical portable grinders to cut, grind and polish granite without guarding abrasive wheel.  This condition expose employees to struck-by hazards.

29 CFR 1910.1000(c): An employee(s) was exposed to Crystalline Silica as reparable quartz in excess of the 8-hour time weighted average limits of 10 mg/m3 e/ /% SiO2+2 listed in Table Z-3:  On or about April 02, 2015, and at times prior thereto, two employees grinding granite stone in the grinding area were exposed to respirable dust that exceeded the 8 hour time weighted average (TWA).  In the grinding area, where an employee performing grinding was exposed to respirable dust containing 25% crystalline quartz at an 8-hour time-weighted average (TWA). The permissible exposure limit (PEL) for respirable dust containing 25% crystalline quartz is 0.435 milligrams per cubic meter and the TWA was 0.840 mgr/m3.  The employee's exposure was 1.93 times the PEL. Sampling was conducted for 96 minutes on April 02, 2015. Zero exposure was assumed for the remaining minutes.  In the grinding area, where an employee performing grinding was exposed to respirable dust containing 25% crystalline quartz at an 8-hour time-weighted average (TWA). The permissible exposure limit (PEL) for respirable dust containing 25% crystalline quartz is 0.435 milligrams per cubic meter and the TWA was 0.536 mgr/m3.  The employee's exposure was 1.23 times the PEL. Sampling was conducted for 117 minutes on April 02, 2015. Zero exposure was assumed for the remaining minutes.
