OSH ACT of 1970 Section (5)(a)(1): of the Occupational Safety and Health Act of 1970:  The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazards of being struck-by, which are causing or likely to cause death or serious physical harm to employees.     This violation occurred on or about February 11, 2015, in the manufacturing shop where an employee was exposed to a struck-by hazards when hoisting material using a jib crane with a half-ton hoist without a functioning safety latch on the lifting hook.         Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the actions it is taking to ensure that employees are not exposed to struck-by hazards.

29 CFR 1910.215(b)(9): The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch.   a. This violation was observed on or about February 11, 2015, in the debris area where employees were exposed to a struck-by hazard when operating a Dayton bench grinder with the left and right tongue guards 0.75 inch and 1.0 inch from the abrasive wheel.     b. This violation was observed on or about February 11, 2015, in the debris area where employees were exposed to a struck-by hazard when operating a Baldor bench grinder with the left and right tongue guards 1.25 inches and 1.5 inches from the abrasive wheel.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all bench grinders have their tongue guards adjusted to the grinding wheel with a maximum opening of one fourth  inch.

29 CFR 1910.219(c)(4)(i): Unguarded projecting shaft end(s) did not present a smooth edge and end and projected more than one half the diameter of the shaft.  The employer does not guard shaft ends that project more than one-half the diameter of the shaft. This violation was observed on or about February 11, 2015, in the manufacturing shop area where employees are exposed to a caught-by hazard while working near a lathe that has a shaft end that projects more than one-half the diameter of the shaft without a guard.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all shafts that project more than one-half the diameter of the shaft are guarded.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible.  The employer does not provide information contained in Appendix D to employees that use respirators on a voluntary basis.  This violation was observed on or about February 11, 2015, at the facility where an employee was wearing an N95 respirator to perform a clean out task.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees that wear respirators are provided and trained on the information provided in Appendix D of the respiratory protection standard.
