29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    The employer does not protect each employee from falling on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level by the use of guardrail systems, safety net systems, or personal fall arrest systems.  This violation was observed at the construction site on February 12, 2015 where employees were exposed to an approximate 7 foot fall hazard while employees were working on the second level floor with an unprotected edge along the staircase without a guardrail systems, safety net systems, or personal fall arrest systems.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are provided protection from falling while on a walking/working surface with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level by the use of guardrail systems, safety net systems, or personal fall arrest systems.

29 CFR 1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided.    The employer does not provide proper access to the employees where there is a break in elevation of 19 inches or more, or no ramp, runway, sloped embankment, or personnel hoist was provided.  This violation was observed at the construction site on February 12, 2015 where and employee was exposed to an approximate 13 foot fall hazard when employees were ascending and descending the third level of a residential structure without a stairway or ladder.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are provided stairway(s) or ladder(s) at all personnel points of access when there is a break in elevation of 19 inches (48 cm) or more, or a ramp, runway, sloped embankment, or personnel hoist are provided.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).    The employer does not protect each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection.  This violation was observed at the construction site on February 12, 2015 where employees were exposed to an approximate 28 foot fall hazard while employees were working on the third level floor of a residential structure without a guardrail systems, safety net systems, personal fall arrest systems, warning line system, or a safety monitoring system.    Kavac, LLC also doing business as Kavac Holding Company, LLC dba Fisher and Associates was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(10) which was contained in OSHA inspection number 966203, citation number 1, item number 5, and was affirmed as a final order on May 19, 2014 with respect to a workplace located at 1707-1713 McGowen, Houston, TX  77004.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are provided protection from falling while engaged in residential construction activities 6 feet (1.8 m) or more above lower levels by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection
