29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Cross braces were used as a means of access. (a) Worksite: A laborer gained access to an approximate 12 ft. high canopy by climbing the rails to the scaffold platform observed to be an approximate 6ft below the point of access, on or about February 12, 2015.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest: (a) Worksite: A laborer conducting chalk line measurements was observed being exposed to an approximate 12 foot fall hazard in not wearing fall protection, as he stood, walked on and across an unguarded canopy platform located above a concrete paved sidewalk, on or about February 12, 2015.
