OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards;    On or About February 9, 2015    Location; 2994 Cropsey Ave, Brooklyn, NY    a). Employees walk and work in the yard and adjacent street where tractor trailers and other heavy equipment operate throughout the day. Employees also guide tractor trailer drivers backing into and out of the gated yard. No procedures were in place to prevent employees from being struck by moving vehicles in and around the yard.     ABATEMENT NOTE: Among other methods, feasible and acceptable means of abatement may include;    1). Develop and implement a policy to address the hazards associated with moving/guiding vehicles into or out of the yard.  This policy must include spotting/flagging operations.       2). Ensure employees are trained and understand the duties of flagging/spotting operations.     3). Ensure employees conducting flagging/spotting operations wear hi visibility safety vests/clothing, hardhats, and use flags and/or paddles during the operation.     4). Instruct employees on the dangers associated with working around moving vehicles and while exposed to moving traffic without the use of proper safety equipment or attire.    5). Ensure that drivers are trained to maintain continuous visual and/or verbal contact with flagmen/spotters.     6). Flagging/spotting operations must be coordinated when multiple vehicles are being moved at one time.

29 CFR 1904.39(a): Starting January 1, 2015, the employer did not report the death of an employee or the in-patient hospitalization of an employee because of a work-related incident.    On or About February 9, 2015, 4:30pm    a)  Employer failed to report to OSHA, a work related injury resulting in the inpatient hospitalization of an employee, within the required 24 hours.
