29 CFR 1903.19(c)(1): Within ten calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section:  a.  The employer has failed to submit abatement certification within ten days of the abatement date, March 6, 2015, for a violation of 29 CFR 1926.1060(b) issued as citation 1, item 2, and described as follows:       At the worksite, the employer did not ensure that employees had a clear understanding and knowledge of the requirements to have an extension ladder in place, properly extended over the working/walking surface, when accessing/egressing from one floor to another.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.     a)     On or about February 13, 2015, at the worksite, the employer did not ensure that employees had adequate access/egress from the second floor to the third floor, thereby exposing employees to a potential 10 to 11 foot fall hazard.

29 CFR 1926.1060(b): Retraining shall be provided for each employee as necessary so that the employee maintains the understanding and knowledge acquired through compliance with this section.     a)     At the worksite, the employer did not ensure that employees had a clear understanding and knowledge of the requirements to have an extension ladder in place, properly extended over the working/walking surface, when accessing/egressing from one floor to another.
