29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel:      a) On or about February 12, 2015 and at times prior, a Caterpillar forklift, Model # V40C was missing the warning signals. The employees working around the forklift were exposed to serious injuries because the warning signals were inoperable.    b) On or about February 12, 2015 and at times prior, a Clark forklift, Model # C5400-40 was not installed with a seat belt. The employees using the forklift were exposed to crushing injuries in the event of a forklift tip-over.    Both forklifts were not taken out of service for repairs prior to the employees' use.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:      a) On or about February 12, 2015 and at times prior, employees were exposed to laceration injuries while using a band saw that was missing a guard cover on the exposed blade. The band saw was not attached with a guard cover.    b) On or about February 12, 2015 and at times prior, employees were exposed to laceration injuries while using a chop saw that was missing a guard cover on the exposed blade. The chop saw was not attached with a guard cover.
