OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees are exposed to struck-by and caught between hazards while removing auto parts without a properly inspected and maintained pneumatic automotive lift. REPAIR SHOP: Employees were exposed to struck-by and caught between hazards while working, where inspections and maintenance of the automotive pneumatic lift had not been conducted. The lift does not have load capacities marked, there are no manufacturers instructions available and there are no frequent/periodic inspections conducted on the lift. Feasible Abatement: Follow an automotive lift inspections and maintenance program as established in accordance with ANSI/ALIOM 2008 Standards for Automotive Lifts Safety Requirements for Operations, Inspections and Maintenance. Perform inspections of the automotive lift by a qualified inspector. Obtain manufacturers instructions for the lift.

The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks shall be in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in Sec. 1910.6. a) Oxygen cylinders were not secured in the pole barn to prevent movement, in that the cylinders were free standing with one cylinders cap removed not secured to prevent tip over.
