29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.   The employer does not ensure that employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects were protected by protective helmets.  This violation was observed on or about February 18, 2015 at the Homewood Suites construction site where employees were exposed to overhead hazards and were not protected by wearing hard hats.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees working in areas where there is a possible danger of head injury from falling or flying objects are protected by protective helmets.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Cross braces were used as a means of egress and access.  The employer does not ensure that scaffold platforms that are more than 2 feet (0.6 m) above or below a point of access have portable ladders, attachable ladders, stair towers, etc. for accessing scaffold.  This violation was observed on or about February 18, 2015, on the south and west sides of the Homewood Suites construction site where employees were exposed to fall hazards when accessing the scaffold platforms and meeting room roof by climbing the cross braces which were 2 feet or more above an access point.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a proper means of access is provided when accessing a scaffold platform and that cross braces are not used to access the scaffold when the scaffold platform is more than 2 feet above or below a point of access.

29 CFR 1926.451(g)(1)(vii): 29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold more than 10 feet (3.1m) above a lower level, not otherwise specified in paragraphs (g)(1)(I) through (g)(1)(vi) of this section, was not protected from falling to that lower level by use of personal fall arrest systems or guardrail systems meeting the requirement of paragraph (g)(4) of this section.  The employer does not ensure employees are protected from falling by the use of a guardrail system or personal fall arrest system.  (a)This violation was observed on or about February 18, 2015 on the west side of the Homewood Suites construction site where employees working on the fifth level of the scaffold without guardrails or a personal fall arrest system were exposed to a fall hazard greater than 10 feet while performing stucco work.  (b)This violation was observed on or about February 18, 2015 on the south side of the Homewood Suites construction site where employees working on the first level of the scaffold above the meeting room roof without guardrails or a personal fall arrest system were exposed to a fall hazard greater than 10 feet while performing stucco work.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected by the use of a personal fall arrest system or guardrails from a scaffold 10 feet or more above a lower level.

29 CFR 1926.452(c)(2): Fabricated frame scaffold(s) were not properly braced by cross bracing or diagonal braces, or both, to secure vertical members laterally and to align them so that the erected scaffold was plumb, square, and rigid.  The employer does not ensure that the frames and panels were braced to secure vertical members together laterally to align them so that the erected scaffold was plumb, square, and rigid.  This violation was observed on or about February 18, 2015 on the west and south sides of the scaffold erected at the Homewood Suites construction site where employees were exposed to fall hazards, caught-in and between hazards, and struck-by hazards when completing stucco activities on a scaffold without cross bracing on the interior of the scaffold to secure vertical members together laterally.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all framed scaffold and panels are braced by cross, horizontal, or diagonal braces, or combination thereof, to secure vertical members together laterally.

29 CFR 1926.501(b)(1): 29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  The employer does not protect employees on a walking/working surface with an unprotected side or edge 6 feet (1.8 m) or more above a lower level.  This violation was observed on or about February 18, 2015 at the construction site on the south side of the building on the roof of the meeting room where employees were exposed to a fall hazard of 6 feet (1.8 m) or more when performing stucco activities on a commercial hotel building without a fall protection system.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees engaged in commercial construction activities 6 feet (1.8 m) or more above lower levels are protected from falling by guardrail systems, safety net systems, or personal fall arrest systems.
