29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146:     The employer is failing to ensure that employees are protected from atmospheric and engulfment hazards.  Employee(s) enter permit required confined spaces including, but not limited to, bins and other confined spaces in the facility without the development/implementation of a written permit space entry program that meets the requirements of this subpart.  Issues required by the standard but not covered in the program include, but are not limited to the following.       a)     Entry Permits are not completed prior to entering the spaces.   b)     The program does not address emergency rescue procedures.  c)     The duties of the attendees, entrants and supervisors are not delineated in the program.

29 CFR 1910.146(d)(5):  Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not evaluate permit space conditions when entry operations were conducted by testing or monitoring the permit space as necessary:     The employer is failing to protect employees entering grain storage bins from hazardous atmospheres in that; the atmosphere is not being tested to ensure that the oxygen content is not less than 19.5%, and that there is not a hazardous presence of combustible gases, vapors and other toxic agents.  The employer has filled out entry permits for entries but has not documented any atmospheric testing having been done.

29 CFR 1910.146(g)(1):  The employer did not provide training so that all employees whose work was regulated by 29 CFR 1910.146, acquired the understanding, knowledge, and skills necessary for the safe performance of the duties assigned:     The employer is failing to ensure that employee(s) required to perform permit required confined space entries have received adequate training required by this sub part.  Employees are circumventing key components of the program when conducting permit required entries including, but not limited to, atmospheric testing of the space prior to entry and utilizing retrieval equipment for rescue.
